Robert Herbst specializes in corporate governance, transactions, litigation, and securities, and has extensive experience with finance, real estate, employment, joint ventures, reorganizations, M&A, start up business matters, litigation, bankruptcy, taxation, and acquisitions.

Accomplishments

Robert Herbst has been recognized as a leading legal professional in Who’s Who in American Law. He has lectured frequently on legal topics to other lawyers. Mr. Herbst is also a world-class athlete and is a 13 time World Champion and 26 time U.S. National Champion powerlifter and helped to run the wresting venue at the London 2012 Olympics.

Experience

Mr. Herbst is an accomplished corporate advisor and attorney with experience providing expert business-oriented advice in matters regarding governance, litigation, finances, and compliance. He has been both a law firm partner and a public company General Counsel and he has handled transactions and litigations for banks, corporations, and high net worth individuals including M&A, joint ventures, reorganizations, intellectual property, and tax cases.

In addition to being a skilled corporate lawyer, Mr. Herbst is an experienced litigator who has personally handled over one hundred trials, proceedings, and appeals in various state and federal courts, including the New York Supreme and Civil Courts, the federal courts for the Southern and Eastern Districts of New York, the US Supreme Court, Bankruptcy Court, the US Tax Court, and the Court of Claims, as well before various state and federal administrative bodies. He has also taken or defended over three hundred depositions.

The cases have been in a wide variety of commercial, contract, securities, IP, employment, products liability, personal injury, and white collar areas. Also, since many cases were settled, he is a skilled and experienced negotiator who obtains favorable settlements for his clients.

As a result of this expertise, he served three terms as Chair of the NY State Bar Committee on Courts of Appellate Jurisdiction, have lectured frequently in CLE programs on litigation topics (most recently on November 14, 2013), taught a program for the National Institute of Trial Advocacy, and judged Columbia Law Schools prestigious Stone Moot Court Competition (most recently in November 2013).
